Taxi Terms and Conditions -
VIENNA TAXI provides services based on the following terms and conditions, the service descriptions and the price lists. Deviating terms and conditions do not apply, even if WIEN TAXI does not expressly contradict them. Deviations from these conditions require the express written approval of VIENNA TAXI. A contract is only concluded if this is confirmed by VIENNA TAXI.
Scope of services
The scope of services is determined exclusively by the written order confirmation from VIENNA TAXI or subsidiary to the written offer from VIENNA TAXI. Information contained in brochures, service catalogues, price lists and similar information is only binding insofar as express reference is made to it. The transport takes place according to the regulations of the Road Traffic Act and the PbefG. The passengers have to follow the instructions of VIENNA TAXI or the chauffeur. If guests act against the instructions, or if they represent a hazard according to the StVO, or the safety of road traffic due to impairments by the chauffeur, WIEN TAXI is entitled to exclude them from the carriage. In this case, WIEN TAXI calculates the full fare including the fixed price or kilometer price and all ancillary and special services.
Airport pickup (airport transfer)
Any change in the agreed pick-up time, for whatever reason, must be communicated to VIENNA TAXI immediately. Any damage caused by failure to notify without delay shall be borne by the customer. The WIEN TAXI chauffeur will be available at the agreed pick-up time at the respective meeting point in the airport terminal or at the meeting point previously agreed in writing, with a name tag or company logo (earlier or later availability must be specified when booking) and will wait up to 60 minutes without separate calculation. A telephone number at which the passenger can reach his chauffeur is given in the confirmation letter. If no contact has been made with the passenger or the customer after the 60-minute waiting period, the chauffeur will return to Vienna without a passenger. The service provided by VIENNA TAXI is then deemed to have been provided and the full fare is due for payment. Additional waiting times requested by the customer will be calculated according to the valid price list.
Prices
The prices include the statutory sales tax in the respective statutory amount. The prices valid on the day of the booking confirmation apply. All-inclusive prices not listed in the price list can only be agreed in writing and are only valid for the agreed travel date and rental period. Additional times and distances are calculated according to the valid price list. Additional costs due to delays are borne by the customer, unless the delays are due to the fault of VIENNA TAXI or the chauffeur. The fare includes passenger transport with normal luggage; the transport of bulky goods requires a separate agreement.
Payment Terms
VIENNA TAXI reserves the right to charge a deposit of up to 50% of the total price before starting the journey or to request a blank charge slip from a valid credit card issued to VIENNA TAXI before accepting an order. Remaining payments are due for payment within the periods stated on the invoice. The timeliness of the payment depends on the receipt of the amount for the unconditional disposal of VIENNA TAXI. In the case of payment by check, the claim is only deemed to have been paid after it has been fully credited. Payments are always used to settle the oldest claim. If the customer is in default of payment, VIENNA TAXI will charge interest of 5 percentage points above the base rate, subject to the assertion of further default damages. A reminder fee of €10 will be charged for the second and each subsequent reminder. The customer reserves the right to prove that the damage was less.
Cancellations and Withdrawal
Cancellations are only effective if they are made in writing or if they are confirmed in writing by VIENNA TAXI orally. For the timeliness of written cancellations, it depends on the access at VIENNA TAXI. Cancellations up to and including 24 hours before the contractually agreed start of the journey are free of charge. In the case of cancellations, WIEN TAXI calculates a share of the basic travel price as compensation. This proportion is:
* 50% for cancellations up to 12 hours
* 80% for cancellations up to 3 hours before the contractually agreed start of performance
* 100% for later cancellations and no-show.
WIEN TAXI calculates expenses regardless of the timeliness of the cancellations if they have already been incurred. The customer is expressly permitted to prove that VIENNA TAXI has suffered no or less damage. WIEN TAXI reserves the right to withdraw from the contract in whole or in part if the customer stops paying, becomes insolvent or, due to external circumstances, it can be assumed that the services will be misused, or the customer violates the obligation incumbent on him under these contractual provisions .
Duties and Liabilities of the Customer
The customer informs WIEN TAXI immediately of any change in his name, his (billing) address, his legal form and his bank details. Likewise, the customer is obliged to provide the necessary information on passengers, time and place of performance. If the customer fails to notify us immediately, he is liable for damage that would have been avoided if he had notified us in good time. The customer undertakes, also on behalf of the passengers, not to misuse the service of VIENNA TAXI, in particular
* not to disrupt or impede the performance of the service
* not to cause harm
* not to violate criminal law
* to strictly observe the smoking ban in the vehicle
* not to refuse to accept the fare.
If a customer violates the above obligations, VIENNA TAXI is entitled to take all necessary measures to eliminate the abuse. In the event of culpable violation, the customer is liable to VIENNA TAXI for damages.
Liability of VIENNA TAXI
VIENNA TAXI is liable to the customer for damages - for whatever legal reason - only in the event of intent or gross negligence and culpable violation of essential contractual obligations by VIENNA TAXI, its legal representatives or vicarious agents. Liability in the event of injury to life, limb or health is based on the statutory provisions. In the event of property damage, the liability of WIEN TAXI is limited to € 1,000.00 per passenger. VIENNA TAXI is not liable for any replacement or additional costs if the passenger is not picked up, this applies to both airport and airport pickups. There is a breach of liability for the vehicles in accordance with the applicable General Insurance Conditions. The customer is responsible for any additional insurance. VIENNA TAXI is not liable for missed appointments and their economic consequences, insofar as these were not the fault of VIENNA TAXI. This includes, for example, delays / delays caused by:
* Traffic jams, road closures
* Vehicle breakdowns or traffic accidents
* bad weather
Für Schäden infolge fehlerhafter Übermittlungen von Daten durch den Kunden übernimmt
WIEN TAXI gegenüber dem Kunden oder Fahrgast keine Haftung.
Governing Law and Venue
Austrian law applies exclusively to all legal relationships between VIENNA TAXI and its customers. Place of jurisdiction and place of performance is Vienna.
Partial invalidity
Should one or more of the above conditions be ineffective, the remaining conditions remain unaffected by the ineffectiveness. Instead of ineffective clauses, the statutory provisions apply.
